Terms of Accommodation
Accommodation contracts and related contracts between Hotel Tomori Aomori (the "Hotel") and its guests are governed by these Terms. Matters not covered by these Terms are governed by law and generally established custom.
Article 1. Scope
These Terms apply to all accommodation contracts and related contracts concluded between the Hotel and its guests. Where the Hotel agrees to a special arrangement that does not conflict with law or custom, that arrangement takes precedence.
Article 2. Application for accommodation
A person applying for accommodation shall provide the guest's name, the dates of stay and expected arrival time, the accommodation charge, and any other information the Hotel deems necessary. A request during a stay to extend beyond the booked dates is treated as a new application made at that time.
Article 3. Conclusion of the contract
An accommodation contract is concluded when the Hotel accepts the application. The Hotel may request an application deposit up to the amount of the basic accommodation charge for the stay, by a deadline it specifies. The deposit is applied first to the accommodation charge, then to any cancellation charge, then to any compensation, and any balance is refunded.
Article 4. Special arrangement not requiring a deposit
Notwithstanding Article 3, the Hotel may agree to a special arrangement under which no application deposit is required. Where the Hotel does not request a deposit or specify a payment deadline when accepting the application, it is deemed to have agreed to such an arrangement.
Article 5. Refusal of the contract
The Hotel may refuse to conclude an accommodation contract where, among other cases: the application does not conform to these Terms; no rooms are available; the guest is likely to act contrary to law, public order or good morals; the guest is a member of or connected with an organised crime group or other anti-social force; the guest behaves in a way that is a significant nuisance to other guests; the guest makes demands of Hotel staff that exceed a reasonable scope; the guest has a contagious disease as defined by law; or accommodation cannot be provided because of natural disaster, facility failure or other unavoidable circumstances.
Article 6. Guest's right to cancel
A guest may cancel the accommodation contract by notifying the Hotel. Where the guest cancels for reasons attributable to the guest, a cancellation charge may apply. Details of cancellation charges are set out in the reservation confirmation or in the booking site's reservation details. If the guest has not arrived by 23:00 on the day of arrival (or two hours after the stated expected arrival time), the Hotel may treat the contract as cancelled by the guest.
Article 7. Hotel's right to cancel
The Hotel may cancel the accommodation contract where a guest falls under any of the cases in Article 5, where a guest does not comply with the Hotel's rules (including smoking in non-smoking areas or tampering with fire-safety equipment), or where accommodation cannot be provided because of force majeure. Where the Hotel cancels for these reasons, no charge is made for services not yet provided.
Article 8. Registration
On the day of arrival, guests register at the front desk with their name, address, contact details and, for guests who do not have an address in Japan, nationality and passport number (a copy of the passport may be taken).
Article 9. Hours of use of rooms
Guests may use their rooms from 16:00 on the day of arrival until 10:00 on the day of departure. For consecutive nights, rooms may be used all day except on the arrival and departure days. Use outside these hours may be permitted for an additional charge. Guests expecting to arrive late at night are asked to email us in advance at info@hoteltomori.jp.
Article 10. House rules
Guests shall observe the house rules displayed in the Hotel.
Article 11. Business hours
The hours of the Hotel's facilities are shown in the Hotel and on the official website. They may be changed temporarily where unavoidable, in which case notice is given by appropriate means.
Article 12. Payment
Accommodation charges are set out in Schedule 1. Payment is made at the front desk on departure or when requested by the Hotel, in cash or by a payment method accepted by the Hotel. Accommodation charges are payable even if the guest voluntarily does not use the room after it has been made available.
Article 13. Liability of the Hotel
The Hotel compensates guests for damage caused to them in the performance or non-performance of the accommodation contract, except where the damage is not attributable to the Hotel. The Hotel carries liability insurance for accommodation providers.
Article 14. Where the contracted room cannot be provided
Where the Hotel cannot provide the contracted room, it will, with the guest's consent, arrange alternative accommodation of the same standard as far as possible. Where it cannot, and the reason is attributable to the Hotel, it pays compensation equivalent to the cancellation charge.
Article 15. Deposited articles
For articles, cash or valuables deposited at the front desk, the Hotel compensates loss or damage except in cases of force majeure; for cash and valuables whose type and value were not declared when requested, compensation is limited to JPY 150,000. For articles not deposited, the Hotel compensates loss or damage caused by its wilful act or negligence, subject to the same limit where type and value were not declared in advance.
Article 16. Baggage and belongings
Baggage arriving before the guest is kept only where the Hotel has agreed in advance and is handed over at check-in. Articles left behind after departure are handled according to the Hotel's instructions or, where the owner cannot be identified, in accordance with law.
Article 17. Parking
The Hotel has no car park. Where the Hotel directs guests to a nearby car park, it provides only the space and does not take responsibility for the vehicle, except for damage caused by the Hotel's wilful act or negligence.
Article 18. Guest's liability
A guest who causes damage to the Hotel through wilful act or negligence shall compensate the Hotel for that damage.
